These Terms and Conditions (“Terms”) govern your use of the website located at luckydogsewerdrain.com (the “Site”) and any drain cleaning, sewer inspection, sewer repair, or related services (the “Services”) provided by Lucky Dog Sewer & Drain (“Lucky Dog,” “Company,” “we,” “us,” or “our”), a company operating in the western suburbs of Minneapolis, Minnesota. By accessing the Site, requesting a quote, or engaging our Services, you (“Customer,” “you,” or “your”) agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or engage our Services.
Lucky Dog provides residential and commercial drain cleaning, sewer line inspection, hydro-jetting, and related plumbing drainage services within its designated service area in the western Minneapolis suburbs and surrounding communities. Service availability, scope of work, and pricing are subject to change without notice and may vary based on property conditions, accessibility, and the nature of the issue diagnosed on site.
Estimates provided over the phone, online, or via the Site are preliminary and based on the information you provide. Final pricing is determined after an on-site inspection or diagnostic camera evaluation, as conditions such as pipe material, blockage severity, depth, and accessibility may affect the total cost. We will make reasonable efforts to notify you of any material change in price before performing additional work beyond the original scope.
You agree to provide our technicians with safe and reasonable access to the areas of your property where Services are to be performed, including clear access to cleanouts, drains, and utility areas. Lucky Dog is not responsible for delays or additional charges resulting from restricted access, locked areas, unleashed pets, or other conditions beyond our control. Appointment windows are estimates; we are not liable for delays caused by prior jobs, weather, traffic, or emergency calls.
Payment is due in full upon completion of Services unless otherwise agreed to in writing (for example, under a commercial service agreement with approved invoice terms). We accept the payment methods listed on your invoice or as communicated by our office. Accounts not paid within thirty (30) days of the invoice date may be subject to a late fee of 1.5% per month (or the maximum rate allowed by Minnesota law, if lower) and may be referred to collections. Returned or declined payments may incur an additional processing fee.
We ask that you provide at least twenty-four (24) hours’ notice to cancel or reschedule a scheduled appointment. Cancellations made with less notice, or missed appointments where our technician is unable to gain access, may be subject to a trip or dispatch fee to cover technician time and travel.
Lucky Dog stands behind the quality of its workmanship. Any specific warranty on labor or parts will be stated in writing on your invoice or service agreement at the time Services are rendered. Except as expressly stated in writing, Services are provided on an “as-is” basis. We do not guarantee that a cleared drain or line will remain free of future blockages caused by tree root intrusion, collapsed or deteriorated pipe, misuse, foreign objects, or other conditions outside our control. Pre-existing pipe damage, corrosion, or defects discovered during service are not covered by any workmanship warranty.
To the fullest extent permitted by Minnesota law, Lucky Dog’s total liability for any claim arising out of or related to the Services shall not exceed the amount paid by you for the specific Services giving rise to the claim. Lucky Dog shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to property damage resulting from pre-existing pipe conditions, undisclosed underground utilities or obstructions, or damage that could not reasonably have been discovered prior to performing the Services. Nothing in these Terms limits liability that cannot be limited under applicable law.
Emergency or after-hours service calls may be subject to additional dispatch fees, as disclosed to you prior to scheduling. Response times for emergency calls are estimates and are not guaranteed.
The content on the Site, including text, graphics, logos, and images, is the property of Lucky Dog Sewer & Drain and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use Site content for commercial purposes without our prior written consent. The Site may include estimates, service area information, and promotional offers, which are provided for general informational purposes and do not constitute a binding quote unless confirmed in writing.
Our collection and use of personal information you provide through the Site or in connection with Services is described in our Privacy Policy. By using the Site or requesting Services, you consent to the practices described there.
You agree to indemnify and hold harmless Lucky Dog Sewer & Drain, its owners, employees, and agents from any claims, damages, or expenses arising from your breach of these Terms, misuse of the Site, or provision of inaccurate information regarding your property or plumbing system.
These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of laws principles. Any dispute arising out of these Terms or the Services shall be resolved in the state or federal courts located in Hennepin County, Minnesota, and you consent to the jurisdiction of those courts.
We may update these Terms from time to time to reflect changes in our Services, business practices, or legal requirements. The “Effective Date” above reflects the most recent revision. Continued use of the Site or our Services after changes are posted constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
